We don’t sell your data. We don’t run ads. We collect only what we need to operate the Platform, and we give you clear controls over your information. This policy explains exactly what we do and what rights you have — wherever you are in the world.

1. Who We Are and How to Reach Us

Losers League is owned and operated by Sparvit Co dba Losers League, a Delaware corporation registered in Texas. We are the data controller for personal information collected through the Platform.

2. Scope — Who This Policy Covers

This Privacy Policy applies to all users of the Platform, including:

  • Visitors who browse without a registered account;
  • Players who register and participate in prediction games;
  • Creators who build and manage games on the Platform.

This Policy does not apply to third-party websites, services, or applications that link to or from our Platform. Those are governed by their own privacy policies.

3. Children’s Privacy — No Users Under 13

The Platform is not directed at children under 13 years of age. We do not knowingly collect, solicit, or retain personal information from any child under 13. If we discover that we have inadvertently collected personal information from a child under 13, we will promptly delete that information.

If you are a parent or guardian and believe your child under 13 has provided us with personal information, please contact us immediately at hey@losersleague.com. We will act without delay to investigate and remove that information.

For users aged 13–17, we apply additional care: we do not use their information for profiling, we do not send them promotional SMS or push notifications without verified parental consent, and we apply stricter data minimization practices to their accounts.

4. Information We Collect

4.1 Information You Provide Directly

When you register, use the Platform, or contact us, we collect:

  • Account registration details: username, email address, and any optional profile information you choose to add;
  • Authentication data: if you sign in via a third-party service (Google, Meta/Facebook), we receive the information that service shares with us under your privacy settings, typically your name and email address;
  • Game activity: picks, predictions, contest entries, game configurations (for Creators), and leaderboard participation;
  • Communications: messages you send through in-game chat, support requests, and feedback you provide to us;
  • Age verification data: where required by applicable age tier restrictions, information you provide to confirm your eligibility.

4.2 Information Collected Automatically

When you access the Platform, our systems automatically collect:

  • Device and connection data: IP address, device type, operating system, browser type and version;
  • Usage data: pages or screens visited, time spent, features used, links clicked, and referring URLs;
  • Game behavior: interaction patterns with games, contest participation history, and prediction activity;
  • Log data: timestamps, error reports, and performance data used to maintain and improve the Platform;
  • Cookie and tracking data: as described in Section 6.

4.3 Information from Third Parties

We may receive information from:

  • Social login providers (Google, Meta), when you authenticate through them;
  • Analytics providers (such as Google Analytics), who provide aggregated usage insights;
  • Promotional or sponsorship partners, where you participate in a sponsored game or prize program and prize fulfillment requires sharing limited contact data.

4.4 Information We Do Not Collect

We do not collect payment card numbers or financial account details (we do not process payments on the Platform). We do not collect biometric data. We do not purchase data from third-party data brokers. We do not run advertising on the Platform and have no plans to do so — we do not collect data for ad targeting.

5. How We Use Your Information

We process your personal information only for the purposes described below. For users in the EEA, UK, and other jurisdictions that require a legal basis for processing, the applicable legal basis is identified for each purpose.

6. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Platform, understand how it is used, and remember your preferences. We do not use advertising cookies or behavioral tracking cookies for ad targeting — we run no ads on the Platform.

6.1 Types of Cookies We Use

  • Session cookies: Temporary cookies that expire when you close your browser. Used to keep you logged in and maintain your active session.
  • Persistent cookies: Stored between sessions to remember your preferences and settings.
  • Analytics cookies: Third-party tools — specifically Google Analytics 4, loaded through Google Tag Manager — that help us understand how users interact with the Platform, measure traffic patterns, and identify areas for improvement. These tools provide aggregated, not individual, insights, and are loaded only after you grant analytics consent in the cookie banner. The data collected includes URLs visited, referrer, screen size, browser type, and a randomized client ID. GA4 retention is configured to 14 months (the free-tier maximum). We do not enable Google Signals or any ad-personalization features.

6.2 Cookies We Do Not Use

We do not use advertising cookies, retargeting pixels, behavioral tracking tools, or any technology designed to build profiles of users for advertising purposes. There are no ads on Losers League.

6.3 Your Cookie Controls

You can control or disable cookies through your browser settings. Disabling session cookies will prevent you from logging in. You may opt out of Google Analytics data collection by installing the Google Analytics Opt-out Browser Add-on, or by toggling off the Analytics category in our cookie banner’s “Manage preferences” panel at any time. We honor the Global Privacy Control (GPC) signal: if your browser sends GPC, analytics and other non-essential third-party services are automatically disabled and their toggles are locked off. The cookie banner appears on first visit for everyone and again any time we introduce a new tracking category so that you can give fresh consent.

7. How We Share Your Information

7.1 What Is Publicly Visible on the Platform

By design, some information is visible to other users as part of normal Platform operation:

  • Your username, game picks, standings, and leaderboard rankings are visible to other participants in the same game;
  • Chat messages you send within a game are visible to all participants of that game;
  • Creator-published game content is visible to all Players who access that game.

Choose your username and public-facing information accordingly — treat it as publicly visible.

7.2 With Creators

If you join a Creator-built game, the Creator may access aggregated participation data for their game — such as total player counts and contest activity — to manage and improve their game. Creators do not receive your email address, phone number, or other private account details.

7.3 With Service Providers

We share information with third-party service providers who assist us in operating the Platform. These providers are authorized to use your information only as necessary to provide their services to us and are contractually bound to protect it. Current categories of service providers include:

  • Hosting and cloud infrastructure providers;
  • Analytics providers (e.g., Google Analytics);
  • Email delivery providers;
  • Customer support tools;
  • Push notification services (for in-app and mobile push);
  • SMS delivery providers (for opt-in text communications).

7.4 With Sponsors and Promotional Partners

If you participate in a sponsored contest or prize promotion, we may share limited contact information (such as your name and email) with the relevant sponsor solely to facilitate prize fulfillment. This sharing will be disclosed at the time of the promotion and only occurs for participants who enter the sponsored event.

7.5 For Legal and Safety Reasons

We may disclose your information when we have a good-faith belief that disclosure is necessary to:

  • Comply with applicable law, regulation, or legal process (including valid government requests or court orders);
  • Protect the rights, property, or safety of Losers League, our users, or the public;
  • Investigate or prevent fraud, security incidents, or other potentially illegal activity;
  • Enforce our Terms of Service or other applicable agreements.

Where legally permitted, we will attempt to notify you of such disclosures.

7.6 Business Transfers

In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your personal information may be transferred as part of the transaction. We will notify you via email or prominent in-Platform notice before your information becomes subject to a materially different privacy policy, and you will have the ability to delete your account if you do not agree to the new terms.

7.7 With Your Explicit Consent

We may share your information in other ways when you have given us specific, informed consent to do so.

7.8 What We Do Not Do

We do not sell your personal information. We do not share your data with advertisers. We do not allow any third party to access your information for their own marketing purposes. This is not a hedge — it is a commitment.

8. Marketing Communications

We may send you promotional and informational communications through the following channels, where you have opted in or where permitted by applicable law:

  • Email: promotional updates, new game announcements, contest invitations, and Platform news;
  • Push notifications: in-app and mobile push alerts about game activity, contest results, and Platform updates;
  • SMS/text messages: transactional alerts (e.g., game reminders, prize notifications) and promotional messages where you have provided explicit consent.

8.1 How to Opt Out

You can opt out of any marketing channel at any time:

  • Email: use the unsubscribe link in any promotional email, or contact hey@losersleague.com;
  • Push notifications: disable them in your device settings or within the Platform’s notification preferences;
  • SMS: reply STOP to any text message we send you, or contact hey@losersleague.com.

Opting out of marketing communications will not affect essential service messages, such as account confirmations, security alerts, or responses to your support requests. We do not discriminate against users who opt out.

8.2 SMS-Specific Terms

By providing your mobile number and opting into SMS communications, you consent to receiving text messages from Losers League. Message frequency varies. Standard message and data rates may apply. You may opt out at any time by texting STOP. For help, text HELP or contact hey@losersleague.com.

9. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to provide the Platform, resolve disputes, enforce our agreements, and comply with legal obligations.

General retention guidelines:

  • Active account data: retained for the duration of your account plus a reasonable period thereafter for legal and dispute purposes;
  • Game activity and picks: retained for as long as the associated game data is maintained on the Platform;
  • Chat and communications: retained for moderation, safety, and dispute resolution purposes;
  • Support communications: retained for up to 3 years following resolution;
  • Anonymized or aggregated data: may be retained indefinitely as it does not identify individuals.

When you request account deletion, we will delete or anonymize your personal information within 30 days, except where we are required to retain it under applicable law or for legitimate legal purposes such as fraud prevention or enforcement of our agreements. We will inform you of any such exceptions at the time of your request.

10. International Data Transfers

The Platform is operated from the United States. If you access the Platform from outside the United States, your personal information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.

For users in the EEA and UK, we rely on the following transfer mechanisms to ensure your data receives adequate protection:

  • Standard Contractual Clauses (SCCs) approved by the European Commission, incorporated into our agreements with service providers who process EEA/UK personal data;
  • Adequacy decisions issued by the European Commission or UK Information Commissioner’s Office (ICO), where applicable.

For users in other jurisdictions with data transfer requirements (including Canada and Brazil), we apply equivalent contractual safeguards with our service providers.

11. Security

No security system is perfect. While we work hard to protect your information, we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for notifying us promptly if you believe your account has been compromised.

In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify affected users and relevant supervisory authorities as required by applicable law — within 72 hours under GDPR where required.

12. Your Rights and Choices

Depending on where you are located, you have specific rights regarding your personal information. We honor all of the following rights regardless of your location, to the extent technically and legally feasible.

12.1 Rights Available to All Users

  • Access: You may request a copy of the personal information we hold about you.
  • Correction: You may request that we correct inaccurate or incomplete information.
  • Deletion: You may request that we delete your personal information, subject to legal retention obligations.
  • Opt-out of marketing: You may opt out of promotional communications at any time (see Section 8.1).

  • We will respond within 30 days (or the timeframe required by applicable law) and may request verification of your identity before fulfilling the request.

We will not charge a fee for reasonable requests. We will not discriminate against you for making a privacy request.

The Platform may contain links to third-party websites or integrate with third-party services, including social login providers and data services. This Privacy Policy does not apply to those third parties. We encourage you to review their privacy policies before providing any personal information to them.

When you connect a third-party account (such as Google or Meta) to the Platform, both this Policy and that third party’s privacy policy apply to the respective information each collects.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, applicable law, or Platform features. When we make material changes, we will:

  • Post the updated Policy on the Platform and update the Effective Date;
  • Notify you by email if we have your address on file;
  • For significant changes that affect how we use your data in ways you would not reasonably expect, seek your affirmative consent before the changes take effect.

Your continued use of the Platform after the updated Policy takes effect constitutes your acceptance of the revised terms. If you do not agree, you may delete your account at any time.
